QLD SPECIFIC

Uncapped commission is a Queensland-only story

Queensland capped agent commission by statute until 2014. When the cap was removed, rates drifted up rather than down, and the state now averages 2.5% and frequently reaches 3.0%. Queensland is the only state where sellers can point at a specific year their selling costs were deregulated, and the highest average rate in mainland Australia is the result.

At 2.5% average and 3.0% at the top end, Queensland commission runs materially above NSW (2.1%) and Victoria (2.0%). On Brisbane’s ~$980K median house that is about $24,500, and a Gold Coast campaign at 3.0% on $1.15M reaches $34,500.

Form 2 disclosure became a seller cost in 2025

Since 1 August 2025, Queensland sellers must give buyers a Form 2 seller disclosure statement with prescribed certificates before the contract is signed. That is a new, non-optional line: $100 to $350 in searches on top of your solicitor’s fee.

No cooling-off at auction cuts both ways

Queensland auction sales carry no cooling-off period, so a successful auction produces an unconditional contract. That is genuinely valuable, and it is also why agents push auction campaigns, which cost more to run than private treaty.

Do QLD sellers pay stamp duty? No.

Stamp duty on a property transfer is a buyer cost in Queensland, not a seller cost. The only tax that can land on a QLD seller is capital gains tax, and that applies solely to investment properties, never to your main residence. Licensing and agent conduct in QLD is governed by the Property Occupations Act 2014 (Qld).
